Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Volha Khvoin ("Developer", "I", "me"), governing your use of the Proxima application ("App") for iOS. By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Parties and Relationship to Apple
You acknowledge that these Terms are entered into solely between you and the Developer, and not with Apple, Inc. ("Apple"). I am solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
2. License Grant
I grant you a personal, non-exclusive, non-transferable, revocable license to use Proxima on Apple-branded devices that you own or control, in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions.
3. Nature of the App & Acceptable Use
Proxima is a client-side network routing utility and proxy protocol manager. It does not provide proxy or VPN server infrastructure. You are responsible for obtaining and configuring your own proxy servers and subscription links.
You agree to use Proxima only for lawful purposes. You must not use the App to:
- Violate any local, national, or international laws or regulations.
- Infringe upon intellectual property, privacy, or legal rights of others.
- Transmit malicious code, viruses, or conduct unauthorized network intrusions.
4. In-App Purchases & Billing
Proxima may offer optional paid features ("Proxima Pro"). All purchases are handled securely through Apple's App Store using your Apple ID. Payment terms, billing cycles, and refund requests are governed by Apple's policies. You can manage purchases in your Apple ID account settings or request a refund at reportaproblem.apple.com.
5. Intellectual Property
Proxima and all associated source code, design, icons, and documentation are protected by intellectual property laws (excluding open-source third-party libraries, which remain subject to their respective licenses).
6. Disclaimer of Warranties
Proxima is provided on an "AS IS" and "AS AVAILABLE" basis, without warranty of any kind, express or implied. I do not guarantee that the App will be uninterrupted, error-free, or that external proxy nodes configured by you will remain accessible or functional.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of your use or inability to use the App.
8. Third-Party Beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
9. Termination
These Terms remain effective until terminated by you (by deleting the App) or by me if you fail to comply with any provision of these Terms.
